2. Website visit; WebAnalytics
You can access my website without providing any data on you person. Unless you actively provide me with additional data on the occasion of such access, exclusively the following data are retained and anonymized immediately upon retention: referrer (previously visited website), requested website or file, type and version of browser, time of access, IP-address in anonymized form (processed only to determine location of access).
I process these data to ensure frictionless connection and the comfortable use of the website, to investigate system security and stability as well as additional administrative purposes on the basis of Art. 6 Para. 1 Sentence 1 lit. f GDPR.
The above-mentioned data are also used by WebAnalytics, a web analytics service of 1&1 IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany for statistical analysis and technical optimization of the web-offering.
3. Email contact; other data
If you contact me via email, I store the data you send me. It is regularly checked if continued storage is necessary or if there is a storage obligation. Depending on the outcome emails are continuously stored or deleted. Data provided to me in the context of the implementation of a separate agreement are handled correspondingly. This processing serves the fulfilment of contracts, precontractual requests, the compliance with legal obligations or my legitimate interests in proper documentation and implementation of business relations. The legal justifications are found in Art. 6 Para. 1 Sentence 1 lit. a, b, c and f GDPR.
4. Updates; email newsletter
You receive my email updates, newsletters and other emails with potential advertising content (Updates) only after you have given me your email address and your explicit approval pursuant to Art. 6 Para 1 Sentence 1 lit. a GDPR. In this context I process exclusively your email address. for documentation purposes the application process (including the timestamp of application and confirmation, IP address and eventual changes to your data). You can at any time unsubscribe from Updates, e.g. via a link at the end of each update or via email to malte@malteholthaus.com.
Updates are sent via Mailerlite UAB, Paupio 46, 11341 Vilnius, Lithuania (MailerLite) as external provider. MailerLite is subject to the GDPR and, pursuant to information provided MailerLite, conforms with its terms. With MailerLite I have entered into a data processing agreement. If you have subscribed to Updates, your email-address is stored by MailerLite and is used for distribution of Updates the analysis of their use; in this context it is e.g. analyzed whether and when Updates are opened and which potentially included links are clicked. In addition information is being stored when and from which IP-address you have subscribed to Updates and confirmed the subscription via double opt-in.
Pursuant to information provided by them, MailerLite can use these data to optimize or improve its own services, e.g. for technical optimization of distribution, for display of the Updates or for commercial purposes to determine the countries of origin of recipients. Based on information provided by MailerLite, they don’t use data of recipients of Updates in order to independently send mails to them or pass these data on to third parties.
Under certain circumstances recipients of Updates are directed to websites of MailerLite (e.g. via links through which Updates can be accessed online). Recipients of Updates can subsequently correct their data (e.g. email address). The data protection policy of MailerLite can be accessed on their website, which might use cookies (https://www.mailerlite.com/legal/privacy-policy).
The use of MailerLite, the statistical analysis as well as the documentation of the subscription process occur based on my legitimate interests to use a user friendly and secure system for Updates (Art. 6 Para. 1 lit. f GDPR).
5. Proliferation of Data
I pass your personal data only on to third parties, if (1) there is a corresponding legal requirement (Art. 6 Para. 1 Sentence 1 lit. c GDPR) or (2) it is legally permissible and required to implement contractual relationships in the meaning of Art. 6 Abs. 1 S. 1 lit. b GDPR.
6. Your Rights
In particular, you have the right to at any time
(a) demand information on your personal data processed by me (in particular about processing purposes, categories of personal data, persons to who these have been disclosed (or categories of persons), planned duration of storage, the right for correction, deletion, limitation of processing or objection, existence of a right to complain, origin of your data (to the extent these have not been recorded by me) and existence of automated decision-making including profiling and if relevant helpful information to its details); Art. 15 GDPR;
b) demand deletion of your personal data stored by me, to the extent its processing is not required to exercise the right to free communication and information, in order to fulfill a legal obligation, for reasons of public interest or in order to assert, exercise or defense legal claims; Art. 17 GDPR;
c) demand restriction of processing of your personal data if the requirements of Art. 18 GDPR are given;
(d) receive your personal data that you made available to me in a structured, usual and machine readable format or demand transmission to another responsible person, Art. 20 GDPR;
(e) revoke your consent in relation to me, with the result that I may not continue any data processing based on such consent, Art. 7 Para. 3 GDPR;
(f) terminate your receipt of the Updates, if you subscribed to them and thereby revoke your consent to their delivery via MailerLite and the conduct of statistical analyses; a separate revocation of your consent to their delivery via MailerLite or the conduct of statistical analyses is not possible; you will find a link to unsubscribe from the Updates at the end of each Update; and
(g) to lodge a complaint with a supervisory authority, Art. 77 GDPR; for this purpose you can usually turn to the supervisory authority of either your usual residence, your working place or my residence.
7. Objection right
To the extent your personal data are processed based on legitimate interests pursuant to Art. 6 Para. 1 Sentence 1 lit. f GDPR, pursuant to Art. 21 GDPR and subject to the conditions stated therein you have the right to object; my legitimate interests in processing may oppose this, with the possible result that I may be allowed to process the data despite your objection. If you want to make use of your revocation or objection right an email to malte@malteholthaus.com is sufficient.
8. Data security
In the context of a website visit I use the widely used SSL-procedure (Secure Socket Layer) with the highest encryption level supported by your browser. Otherwise I use technical security measures to protect your data against accidental or intentional manipulations, partial or total loss, destruction or unauthorized access by third parties.
II. Copyright etc.
The content and works on these pages created by me are subject to German copyright. The multiplication, amendment, distribution and any art of exploitation beyond the limits of copyright laws require written approval, downloads and copies of these pages are only allowed for private noncommercial use. To the extent content on these pages were not created by me, copyrights of third parties are respected. In particular is content of third parties marked as such. If despite this you recognize a violation of copyright or similar laws, please inform me accordingly. Upon knowledge of a violation of rights I will without undue delay remove corresponding content.
I herewith object to the use of contact information published on these pages to send not explicitly requested advertisement or information material. in case of unrequested delivery of advertising information, for example via spam email, I reserve the right to exercise my rights.
